Terms of Service β€” Make Art With Confidence

The terms "we", "us", and "our" refer to Natura Illustrata srl ("Company"), a limited liability company incorporated under Italian law, with registered office at Via Per Curnasco, 52 β€” 24127 Bergamo (BG), Italy, P.IVA: 04870540160. The term "Site" refers to www.makeartwithconfidence.com and any related subdomains.

Make Art With Confidence ("MAWC") is a creative development program offered by Natura Illustrata srl, designed to help artists build foundational skills, develop a unique artistic style, and pursue a professional creative practice. The program is available in the following formats:

  • MAWC Self-Paced β€” a fully recorded, self-directed version of the program accessible immediately upon purchase
  • MAWC Cohort β€” a structured group experience with fixed start dates, live sessions, and peer interaction
  • MAWC Mentorship β€” an intensive 3-month program including live sessions, personalized feedback, and direct mentorship from Anastasiia Morozova

(collectively referred to as "Program" or "Services")

The terms "user," "student," "you," and "your" refer to all visitors, registered users, and paying participants of the Site and/or Program.

By accessing or purchasing any version of the Program, you confirm that you have read, understood, and agreed to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy (collectively, "Agreements"). If you do not agree, you must not use the Site or purchase the Program.

1. Eligibility

You must be at least 18 years of age to purchase or participate in the Program. By completing your purchase, you confirm that you meet this requirement. If you are purchasing on behalf of a minor, you assume full legal responsibility for their participation.

2. Program Formats and Access

Access to the Program is granted upon successful completion of payment. The specific content, duration, and features available to you depend on the version purchased:

  • Self-Paced: Immediate access to all recorded materials upon purchase. No live sessions are included.
  • Cohort: Access to recorded materials plus live group sessions scheduled within a fixed cohort calendar. Access to live sessions is limited to the duration of the cohort.
  • Mentorship: Access to recorded materials, live group sessions, live feedback sessions, and direct mentor interaction for a period of 3 months from the official program start date.

The Company reserves the right to adjust program schedules, session formats, and content at its discretion, provided that the core educational value of the Program is maintained.

3. Right of Withdrawal and Refund Policy

Our Program constitutes digital content delivered immediately upon purchase. Under EU Directive 2011/83/EU and D.Lgs. 206/2005, consumers have a 14-day right of withdrawal from the date of purchase. However, this right lapses when the consumer expressly requests immediate access to the digital content and acknowledges that by doing so they waive their right of withdrawal.

By completing your purchase, you confirm that you have requested immediate access to the Program content and acknowledge that your right of withdrawal is thereby forfeited from the moment access is granted.

All sales are therefore final once access has been granted. If you have not yet accessed the Program content and wish to withdraw within 14 days of purchase, please contact us atΒ [email protected] before accessing any materials.

For the Mentorship format, given its intensive and cohort-based nature with limited enrollment, no refunds are available after the program start date under any circumstances.

If you experience payment or technical issues, please contact our support team at [email protected]

4. Installment Payments

Where the Program is offered with an installment payment plan, you agree to complete all scheduled payments regardless of whether you continue to actively participate in the Program. Failure to complete scheduled payments may result in suspension of your access until the outstanding balance is settled.

5. Intellectual Property

All content within the Program β€” including but not limited to video lessons, written materials, workbooks, exercises, feedback recordings, live session recordings, graphics, and course structure β€” is the exclusive intellectual property of Natura Illustrata srl and is protected under:

  • Law No. 633/1941 (Legge sul Diritto d'Autore)
  • Legislative Decree No. 30/2005 (Codice della ProprietΓ  Industriale)
  • Berne Convention and TRIPS Agreement

Your purchase grants you a single, personal, non-transferable, non-exclusive license to access and use the Program content for your own private creative development. You may not:

  • Share your login credentials with any other person
  • Record, download, copy, or redistribute any part of the Program content
  • Use Program content for commercial teaching purposes without written consent
  • Resell or sublicense access to the Program in any format

Violation of these terms constitutes copyright infringement under Italian and international law and may result in immediate account termination without refund, as well as legal action for damages.

6. Account Sharing and Access Monitoring

Each purchase grants access to a single individual account. Account sharing is strictly prohibited. The Company reserves the right to monitor access patterns and terminate accounts where unauthorized sharing is detected, without refund.

7. Participant Conduct

The MAWC community β€” including live sessions, group calls, and any associated community platforms β€” is a professional, respectful, and supportive environment. You agree to:

  • Treat fellow participants and instructors with courtesy and respect
  • Refrain from sharing, promoting, or selling third-party products or services within the community
  • Not record live sessions without prior written consent from the Company
  • Not share other participants' personal information, artwork, or feedback outside the community

The Company reserves the right to remove any participant whose conduct is disruptive, harmful, or in violation of these terms, without refund.

8. No Confidentiality in Group Settings

Given the group format of the Cohort and Mentorship programs, information shared in live sessions, group calls, or community spaces is not treated as confidential. We maintain a respectful environment, but we advise against sharing personal or sensitive information you wish to keep private.

9. Feedback, Testimonials, and Artwork

By submitting feedback, testimonials, or artwork for review within the Program, you grant Natura Illustrata srl a non-exclusive, royalty-free, perpetual, worldwide license to reproduce, publish, and distribute such content for marketing and promotional purposes, including on the Site, in emails, and on social media. You may revoke this permission at any time by contacting us in writing.

Use of your image or video likeness for external marketing (e.g. promotional videos, advertisements) will only occur with your separate, explicit written consent.

10. No Guarantee of Results

The Program provides educational content and creative guidance. Individual results depend on personal effort, commitment, and many factors outside our control. The Company makes no guarantee of specific artistic, professional, or financial results from participation in the Program.

11. Disclaimer

The Program and all associated materials are provided "as is." To the maximum extent permitted by applicable law, the Company disclaims all warranties, express or implied, regarding the Program's fitness for a particular purpose, uninterrupted availability, or freedom from errors.

12. Limitation of Liability

To the extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, or exemplary damages arising from your use of or inability to use the Program, including but not limited to loss of income, loss of data, or emotional distress. Nothing in this clause limits your rights under mandatory EU or Italian consumer protection law.

13. Lifetime Access

Where "lifetime access" is referenced in connection with the Self-Paced version, this refers to the operational lifetime of the Program as maintained by the Company. If the Company discontinues the Program for any reason, access will terminate. We will provide reasonable advance notice where possible.

14. Live Events and In-Person Activities

Any costs related to attending optional in-person events, workshops, or retreats associated with the Program are your sole responsibility unless explicitly stated otherwise.

15. Third-Party Platforms

The Program is hosted on Kajabi (Kajabi LLC, USA). By accessing the Program, you also interact with Kajabi's platform, which has its own Terms of Service and Privacy Policy. The Company is not responsible for Kajabi's platform availability, technical issues, or data practices beyond what is covered in our own Privacy Policy.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. Any disputes shall be subject to the jurisdiction of the courts of Bergamo, Italy, without prejudice to your rights under mandatory EU consumer protection laws, including Regulation (EU) 1215/2012, which preserves your right to bring proceedings in your country of habitual residence.

17. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at [email protected] to seek an amicable resolution. If direct resolution fails, disputes may be referred to mediation before escalating to litigation.

In accordance with EU Regulation No. 524/2013, consumers residing in the EU may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

18. Changes to These Terms

We reserve the right to update these Terms at any time. For material changes affecting your rights or obligations, we will notify you by email at least 14 days before the changes take effect. Continued use of the Program after that date constitutes acceptance of the revised Terms. Non-material changes (corrections, clarifications) are effective upon posting.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
